FAULTY & DAMAGED GOODS
In the event of faulty or damaged goods, please call us on 01461 701196 or e-mail us at overlandgear@yahoo.com with your order number, description of goods, and nature of the fault. you will be issued with a returns number to include with your returned goods. Please return item(s) to the address listed, including the invoice, an explanation of the fault, and your returns number. FAULTY GOODS MUST BE NOTIFIED WITH 7 DAYS AND RETURNED WITHIN 28 DAYS. We will arrange for either a replacement or a refund to your credit card. If you have any problems, please do not hesitate to contact us.
PRICES
The prices payable for goods and services are as set out in our web site. Prices are correct at time of order but we do however reserve the right to change prices without prior notice subject to errors, omissions and exclusions.
CANCELLATION
We reserve the right to cancel the contract between us if: The item ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel the order we will notify you by e-mail and will refund your credit card as soon as possible, but in any event, within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
EVENTS BEYOND OUR CONTROL
We shall have no liability for any failure to deliver your order, or any delay in doing so, or for any damage or defect to goods delivered, caused by any event or circumstance beyond our reasonable control including without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, or accident. If you wish to return any item due to circumstances beyond our control, carriage costs must be paid by the customer. A refund will only be issued within 28 days of purchase minus any delivery charges incurred on the initial transaction.
OUR SERVICE
We reserve the right to change terms at any time, without notice, or as they may be modified from time to time. Amendments will take effect when posted on our web sites. however, the terms current at the start of a particular transaction will apply until the transaction is complete.
INFORMATION YOU PROVIDE
You grant us a non-exclusive, world-wide, perpetual, irrevocable, royalty-free license to use any information you provide to us, (ie mailing list). Such information shall be legal, decent, honest and truthful, shall not infringe ant third party's rights, shall not contain any computer viruses or other malicious computer programming routines, and shall not link to any other web sites.
SECURITY
We use third party services to secure and protect your credit card information. However, any losses incurred or sustained by you in transmitting information shall be borne solely and exclusively by you and in no event shall any losses in whole or part be borne by ourselves or our representatives. If you are using a public computer you must sign out in accordance with their procedures when finished. AVAILABILITY OF WEB SITE Whilst we endeavour to make our web sites available at all times, we cannot guarantee that they will operate continuously or without interruptions from time to time.
GOVERNING LAW
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us. English law to include Data Protection Act 1998, and The Consumer Protection (Distance Selling) Regulations 2000.
SUBSTITUTION POLICY
If, for any reason, we are unable to supply any item you have ordered, we will supply a substitute product of similar specification, and of similar or greater value. If you prefer to wait for your product to be re-stocked, or wish to have a refund on any out-of-stock products, please un-check the Substitution Policy box.
